Abstract

Background. The relevance of the research topic is determined by its scientific and theoretical significance associated with the refinement of the conceptual apparatus of the science of constitutional law. The author aimed to study the relationship between the foundations of the constitutional system, the constitutional state and constitutionalism.
Materials and methods. The realization of this goal was achieved on the basis of the analysis of numerous scientific literature, the identification of a variety of points of view on the issues under study and the development of the author’s position. The article uses the following research methods: comparative legal, logical, institutional, formal legal, historical.
Results. The article consistently considers the constitutional system, constitutional state, constitutionalism as the main categories of constitutional law in their interrelation. In polemics with other authors the concept and essence of the specified categories is revealed, their interrelation and a ratio with each other is revealed.
Conclusions. On the basis of the analysis it is concluded that the essence of the constitutional state is manifested through the foundations of the constitutional system, which at the same time are one of the manifestations of constitutionalism. Hence, the concepts of constitutional order, constitutional state, constitutionalism are the basic and related categories of constitutional law. Ignoring at least one of them can destroy the whole theory of modern constitutionalism.
